Reason I participated in this discussion was to highlight some of the things that people should think of and determine best courses of actions.
attornies and the like are very busy doing their current work.There is a high chance that they may not do the proper due diligence or ask you the proper questions before they file.
You all need to have a very thorough discussion with your attornies and take second opinions where necessary.I can tell you that depending on your attornies case load; how many phone calls they are taking; they may provide you advice that would suit their own needs (ie., get you off the phone the quickest and let them carry on with their normal duties).
Unless the law changes; everyone will be stuck in retrogression for a long time.If UScis should pre-adudicate and deny 485's then you will lose the opportunity to re-file for quite some time.
This is an important topic as this is what uscis mainly looks at in the 485 stage.I suggest people discuss it with their attornies and make sure you have every situation covered before you file the 485.

We should only oppose increased hardships/obstacles in the form of LCA/administrative hurdles for H-1 renewals.Something that will only enrich the lawyers more, and increase the workload for USCIS.
Whether there should be 65K H1s, or 115K, or zero.That should not be our concern.
One possible solution is to establish a separate quotas for companies perfoming R&D in the US.Something like this already exists in the tax code where companies establish eligibility for the R&D tax credit.A similar bar could be used to administer a R&D quota for H1B or GC.That should address concerns around the quota for top US companies.
lank shield shape.make Desis who come here are all engineers and well educated.I couldn't believe that some of them are falling for the realtor tricks.I know someone who last year paid 200K more on an advertised price of 1million.He said the realtor told him that there was bidding war and he kept rising it and eventually got the house for 1.2million.What stupidity.Doesn't he know about phantom bids that realtors use to jack up the price.:( This is last year end when housing here started crashing.I asked him how he is going to pay when his arm resets.He says he will refinance.God save him.
They are well educated but not street smart.Realtors are same everywhere and they know, how to misguide.

basic,lank,border,panel When I first started to get to know consulatants and staffing companies; I thought that this wh*le bribe system; creating positions at end clients; how consultants got selected, etc., was a big racket.
However; when I did introspection of how things worked in my industry; I pretty much concluded that it was done in same way but at much, much higher levels.
USCIS is just keeping it pretty simple these days; show us that there is a job with an end client that requires a degree.They pretty much know that it is impossible.Even if you can get one; they pick on it pretty good and still deny it.
The system was actually designed for staffing companies when you think about it.When h-1b was first created; no one would have used it if it wasn't for staffing companies.Typical US companies wouldn't have the network to get foreign employees unless they were already here.To get them from a foreign country then the only companies who can really do so are the staffing companies.
The main reason that I can't get behind lifting of the country quota is exactly this reason.You have a lot of companies run by the same nationality who will only recruit their own people.The staffing companies don't advertise in Indonesia, Germany, Brazil, etc.They only go after their own people.The wh*le monopolization of visas was used to prevent this type of behaviour.
I always thought that there are people from around the world who want to come here but can't because they are not part of the "system".You can see this in the greencard lottery.Almost 9 million people apploy to get here through this.If they had their own country people looking to get them here then there would be a more equal distribution of visas.
I think people need to step back and think that this is one of the reasons why they have country quotas.No matter what people think that they re being hired for their skills and that employers don't care about their nationality; people need to understand that a "system" has been designed that is benefitting a few nationalities.Once you can get here then you can find your way.However, if you can't get here then you can't find your way.
Its rather ironic that system created for staffing companies was misused so rampantly that they are the ones bearing the brunt of this onslaught.
So according to your experience are they are always denying applications even when the employee is able to furnish a contract with the end client ?This is indeed surprising and alarming.I am just worried this can spill in to everything that USCIS adjudicates.
on the other hand how do you put an end to this misuse ?
Should'nt they establish a set of guidelines for the employers and employees?So both are aware what they are up against.Looks like its pretty arbritary right now and USCIS indeed playing the "hand of god"

Simple shield shape. Oh my gosh..This much argument.I do not know the PD porting is law or rule.If it is law, one can not file suit against the amended law.But one can request the law maker to change.If it is a rule, one may do that.But it does not have any merit.It is waste of time.
PD porting, in theory, is very genuine.(may be not-genuine in many cases; just to cut-short the line or line jump by creating a EB2 job) So, one cannot challagne that.Here is why.A cook may have a PD 2001 in EB3.He has right to study PhD and apply in EB1 catagory, by poring PD.There is no violation of ehics here.

make this shield shape my USCIS adjudicators follow a manual and very specific set of procedures as laid out by their headquarters.Sometimes in the gray areas or areas of interpretation they are given wide latitude in how to interpret those rules.
However; document list and procedure for getting them is very prescribed.When person posts of their experience with USCIS and it is very different then what their policies, procedures are then it makes it very suspicious...
Everything you have posted falls in line with department of labor audit and not local uscis office interviews or requests for information from local office interviews.
If what you are saying is accurate then you and your company should have consulted with your attornies and specifically asked for this in a request for evidence and a*sessed the legality of this request and pulled the officer back and sent in only what was required by law.
California service center back in 2004/2005 was denying 140's due to "temporary job" issue.Lawyer stupidly in replying to ability to pay part of rfe sent in contracts like you do in H-1b and put it in front of uscis that the contracts were temporary.USCIS had no choice but to deny the 140's and this was one of those issues (one of the people actually had their approved 140 reopened and denied for this issue).That particular company had 35 straight denials over this issue.
